David is of counsel to Becker Gurian.  David’s practice focuses on providing land use, zoning, development and related municipal legal services to private sector and municipal clients.  He regularly represents developers, builders, owners and investors in every phase of the development process – from site acquisition and strategic planning through annexation, zoning, platting, and installation of off-site infrastructure, to dispositions and leasing.   David’s experience counseling city councils, planning commissions and their professional staff is a foundation of his ability to counsel private sector clients in the creation and implementation of practical strategies for securing favorable municipal approvals.
Recent projects include:

• Represented developers of big-box and lifestyle retail centers in the negotiation and drafting of purchase and sale agreements, site development agreements with anchor retailers, and easement agreements; secured PUD and subdivision plat approvals.

• Represented a shopping center owner in several mall expansion and renovation projects, securing PUD, site plan, special use and related zoning approvals, and provided strategic counsel regarding government relations and site expansion opportunities.

• Represented big box retailers and property owners in contested hearings; negotiated community benefit agreements to resolve concerns of opponents, municipal officials and other stakeholders.

• Represented a regional hospital in planning a new emergency care building and securing approvals – against organized, large-scale neighborhood opposition – for demolition of a building located in a landmark district, street vacation and upzoning. 

• Represented a real estate fund in the acquisition, annexation, zoning and entitlement of over 2,000 acres throughout the metropolitan Chicago area and sale of entitled lots to national home builders.

Previously, David was Senior Counsel in the real estate practice group at Foley & Lardner LLP and an associate at Quarles & Brady LLP. 

David received his B.A. from Wesleyan University in 1992, his M.A. in American history from UNC-Chapel Hill in 1994, and his J.D. from Chicago-Kent College of Law in 1998.  At Chicago-Kent, David was a member of the Moot Court Honor Society, a recipient of the Lowell J. Thomas Academic Scholarship and of the American Jurisprudence Award for excellence in First Amendment Law, and a judicial extern to the Honorable James B. Zagel, United States District Court, Northern District of Illinois.   David is an active member of the Urban Land Institute and serves on ULI’s Regional Infrastructure Planning Committee.   David is also a member of the American Planning Association, the ABA and the Chicago Bar Association.
